What is ATF Form 1?

ATF Form 1 or Application to Make and Register a Firearm is the required document to be utilized by individuals to create an NFA item, ranging from altering the configuration of an existing firearm to manufacturing an entire unit on his or her own.

Every person (other than a licensed manufacturer who has also paid the required SOT to manufacture NFA weapons) must complete Form 1.

The approval of the Form 1 application authorizes the applicant to make the firearm. The approval does not authorize the applicant to convey or ship the firearm to another person to manufacture the NFA firearm.

How to fill out ATF Form 1?

Two identical copies of the application must be prepared. All entries must be made in ink. All required signatures must be original and entered in ink. Photocopies or other facsimile or carbon copy signatures are not acceptable. Under no circumstances will a form filled in by use of a lead pencil be accepted. All changes made on the form must be initialed and dated by the applicant.

1. Type of Application.
a. Select the appropriate box. Located at the upper right of the application.

a. Select the box that applies to you.
b. If you are applying as a different entity you can select individual or any of the other entity options that best describes your entity.

a. Trade name.

      • Write down if there’s any.

b. Applicant’s name and mailing address.

      • Your gun trust name and the address where the NFA firearm will be stored at. This doesn’t have to be the same address of the gun trust. But where the firearm will be physically stored.

c. P.O. Box.

      • If the above address is a P.O. Box indicates the address where the NFA firearm will be stored.

d. County.

      • This is the county, parish, or borough that the NFA firearm will be stored at. This is not the country.

e. Telephone.

      • Enter your telephone number here.

f. Email Address.

      • Enter your email address here.

a. Manufacturer.

      • The original manufacture of the NFA firearms name and address goes here.

b. Type of Firearm.

      • This is where you indicate the type of NFA firearm you are trying to get a tax stamp for. Options include: Silencer, Short-barreled rifle, Short-barreled shotgun, Machine Gun, Any Other Weapon (AOW), or Destructive Device.

c. Caliber or Gauge.

      • This is the caliber or gauge of the NFA firearm. 5.56 MM or .223 Cal is acceptable.

d. Model.

      • This is the model name of the NFA Firearm.

e. Length of barrel.

      • This is the length of the barrel.
      • This information can be obtained from the manufacturer or by using a measurement tool.

f. Length Overall.

      • This is the overall length of the NFA firearm.
      • This information can be obtained from the manufacturer or by using a measurement tool.

g. Serial Number.

      • This is the serial number that is engraved on the NFA firearm.

h. Additional Description.

      • Your gun trust information goes here.
      • You can also add additional calibers and barrel length configurations here.

i. State Why You Intend to Make Firearms.

      • This should say “Any Lawful Purpose” or "Investment and All Other Lawful Purposes".

j. Type of Destructive Device.

      • This box remains unchecked unless you are making or manufacturing a destructive device.

k. Reactivated.

      • Select no unless you restore a registered unserviceable NFA firearm to a functional condition.
      • This action incurs the making tax liability.

5. Applicant’s Federal Firearms License.

a. If you have an FFL and/or SOT license and you are applying as an individual enter that information here.

6. Special Tax Status

a. Add your FFL and/or SOT license numbers, if you are applying as an individual can speed up your approval process.

7. Signature of Applicant.
a. The individual or settlor of the trust name goes here.
b. If purchasing with a NFA Gun trust, you will write the name of the settlor and trustee after that.
8. Name and Title of Authorized Official.

a. Print your name here and after put Trustee.

b. Otherwise print and sign your name.

9. Date.

a. Date the Application.

10. Law Enforcement Notification.

a. This is the agency name, name of official, title and address where you will send the CLEO Copy of your paperwork to.

For questions 11 to 17, only answer when it is applicable to you. This part should be left blank if you are using a NFA gun trust. These questions are answered in the ATF Form 54320.23 for each responsible person in the gun trust. At the bottom of page 2 You should sign the document as a trustee “Your name / Trustee” or “Your Name as Trustee” and the date you signed.

“CERTIFICATION”.

18. Number of Responsible Persons.

a. This is the number of responsible persons in your gun trust. This only includes the Settlor and the Co-Trustees. Successor Trustees and Beneficiaries are not responsible persons.

19. Name(s).

a. List up 8 responsible persons that are in your gun trust. If you have more than 8 responsible persons in your gun trust you can attach another list on a separate sheet. This is left blank if you are filing as an individual.

20. Method of Payment.

a. Here are the methods of payment. Check the box of the payment method you are choosing. Only fill out the rest if you are paying with a credit card/debit card.

The completed Form 1, in duplicate, with fingerprint cards, photographs of the applicant, and payment of the $200 making tax should be mailed to:
