Forms 4, Application for Tax Paid Transfer and Registration of a Firearm, are for use in transferring serviceable NFA firearms in the following instances: transfers by non-FFLs/SOTs to other such persons; transfers by non-FFLs/SOTs to FFLs/SOTs.

What is the ATF Form 4?

The ATF Form 4, officially known as the“Application for Tax Paid Transfer and Registration of a Firearm” is a form submitted for a transfer to an individual or legal entity such as a trust.

This form is an application form and you will have to wait for the approval. If you’d prefer to get NFA firearms in days rather than months, you should look into getting an FFL

How to fill out the ATF Form 4?

1. Type of Transfer
Select the appropriate type of transfer ($5 or $200).

2a. Transferee’s name and address
Provide the name of the individual or gun trust and the address where the NFA firearm will be stored. Make sure to check the appropriate box at the bottom of 2a. If the firearm is stored by an individual, select “Individual”. If stored by a trust or legal entity, select “Trust or Legal Entity”.

2b. County
Enter the county, parish, or borough where the NFA item will be stored.

Sections 3 & 4 will be completed by the Transferor.

3a. Transferor’s Name and Address
Enter the name and address of the transferor.

3b. Email address
Enter the email address of the transferor.

3c. Transferor’s Telephone Number
Enter the telephone number of the transferor.

3d. Decedent’s Name, Address, and Date of Death
Provide the name, address, and date of death of the decedent. This section must only be completed if the item is being transferred to a gun trust because it was inherited by the customer as an heir.

4a. Manufacturer
Enter the name and address of the manufacturer of the NFA firearms.

4b. Type of Firearm
Enter the type of NFA firearm you want a tax stamp for (silencer, short-barreled rifle, short-barreled shotgun, Any Other Weapon (AOW), destructive device, or machine gun).

4c. Caliber or Gauge
Enter the caliber or gauge of the NFA firearm. Do not use nicknames in this field. Provide the proper term. For machine guns, write “n/a”.

4d. Model
Enter the model name of the NFA Firearm.

4e. Of barrel length
Enter the length of the barrel itself. For silencers, write “n/a”.

4f. Overall Length
Enter the overall length of the NFA firearm.

4g. Serial Number
Provide the serial number engraved on the NFA firearm.

4h. Additional Description or Data Appearing on Firearm
Enter any additional information or markings that appear on the NFA firearm.

5. Transferee’s Federal Firearms License
If the buyer is an individual, enter their Federal Firearms License information. For gun trusts, leave the box blank.

Transferee’s Special Tax Status
6a. Employer Identification Number

Provide the individual buyers federal EIN or social security number. For gun trusts, leave blank.

6b. Class
Enter the class.

7. Transferor’s Federal Firearms License
Enter the seller’s Federal Firearms License number. If transferring an already owned NFA firearm into your gun trust, leave blank unless the item is located at an FFL dealer.

Transferor’s Special Tax Status
8a. Employer Identification Number

Provide the transferor’s federal EIN or social security number.

8b. Class
Enter the class.

9. Signature of Transferor
Provide the NFA firearm dealer’s signature here.

10. Name and Title of Authorized Official
Provide the name and title of the dealer.

11. Date
Provide the date the form is filled out by the dealer.

12. Law Enforcement Notification
Enter the agency or department name, the agency official’s name, and his or her title, and address.

13. Transferee Necessity Statement
Provide the name and title of the individual or settlor of the trust. For the reason, you may list whatever applies to you (“Investment and All Other Lawful Purposes”, “Any Lawful Purpose” or “Investment and All Other Lawful Purposes”).

14 to 17. Transferee Questions
If you are an individual not purchasing through gun trusts, then you have to complete this section. Answer the questions truthfully and add your passport photo.

“CERTIFICATION”
For individuals, provide your signature and enter the date with your name.
For gun trusts, provide your signature and your title. Provide the date the form was completed and signed.

Sections 18 to 19 are only for gun trust transfers.

18. Number of Responsible Persons
Enter the number of responsible persons in the gun trust or legal entity, including the settlor and co-trustees.

19. Responsible Person Name(s)
Enter the name of the responsible persons. You may list up to 8 persons on this form. You may list other responsible persons on a separate sheet if there are more than 8.

20. Method of Payment
Select the payment method you will use (Check, Cashier’s Check or Money Order, Visa, Mastercard, American Express, Discover, or Diners Club). Fill out the credit/debit card information if applicable.

Submission

Submit the completed ATF Form 4 along with other required documents to:

You must also submit this form to your CLEO to the address you entered in Section 12.

Tips:

  • If you don’t know what CLEO means, it stands for the chief law enforcement officer (CLEO) which is considered to be the Chief of Police; the Sheriff; the Head of the State Police; or a State or local district attorney or prosecutor of your county.
  • For each responsible person listed on Section 19, a completed Form 5320.23 must also be submitted.
  • If ever your application is denied, the money will be refunded.
  • All signatures must be signed in blue or black ink.
  • The following files must be submitted along with the ATF Form 4: ATF Form 5320.23 for all Responsible Persons, Two Passport Photos (only needed for individuals), two Fingerprint Cards on FBI Form FD-258, extra information for “Yes” answers to Section 14 A-H (if applicable), Check for $200 for all NFA firearms (if $200 was selected in Section 1), and a photocopy of your NFA Gun Trust Documentation (for gun trusts only).
  • The usual ATF approval process wait time is 10 months.
