Usually, a Late Rent Notice is the first step in attempting to evict a tenant who always fails to pay rent on time.

The document is sometimes referred to as “Notice to Pay Rent” or “Failure to Pay Rent Notice” as this is usually given to tenants to demand payment for late rent. Although the form is more informal than an eviction notice, as a tenant, it is important to take it seriously. If the late rent notice is disregarded, your property manager will most likely begin the eviction procedure once the grace period has expired, which usually takes three to five days.

As a landlord, you may use the Late Rent Notice document if:

  • Your tenant has not paid the rent on time, and you wish to send a written notice for payment, which may include late fees.
  • You want to emphasize to your tenant the importance of making timely payments.
  • You might consider eviction in the future if the rent continues to go unpaid, since a record of late payments will help support your legal eviction.

Most states allow landlords to issue the notice on the first day that the rent is late; because most leases require rent to be paid by the first of the month, this is frequently on the second (although a few states allow extra time if the first day of the month falls on a weekend or holiday).

You can deliver the notice in person or send it via certified mail, which provides proof of delivery. Another option is to email it with a “read receipt” notifying you when the tenant opens the message. Whatever way you would send it, keep a copy of the late rent notice on file for your reference.

As a landlord, you are not mandated by law to issue a Late Rent Notice. However, it is a wise step to take before filing a motion in the Magistrate Court to reclaim the property.

Failure to meet the late rent notice will result in the termination of tenancy. In most states, the landlords are required to give tenants three to five days to pay up before facing a termination or eviction notice. If you are a tenant, it is important to act fast once you receive the notice. As much as possible, make sure to pay your rent on time to prevent being served with a late rent notice.
