What is a Sublease Agreement?

A Sublease Agreement is a contract between an existing tenant and a third party, the subtenant, who will rent all or part of the property from the existing tenant. A sublease cannot go longer than the original lease’s termination date.

In a sublease, the subtenant is subject to the terms and conditions of the original lease. Moreover, the original tenant is completely responsible for all damages, rent payments, and any violations of the initial lease agreement.

A Sublease Agreement Form is often used when the original tenant is unable to fulfill the conditions of their lease due to the need to (temporarily) relocate, or the desire to bring in a roommate. Many landlords don’t allow subletting without their consent, so it is important to check the terms of your lease before agreeing to this arrangement.

When drafting a simple sublease agreement, include the following sections:

  • Premises – address and description of the residence to be leased
  • Tenant – full name and address of the original tenant
  • Subtenant – full name and address of the subtenant who is taking over the lease
  • Term – when the sublease will begin and end
  • Original Lease – details of the original lease, including the date and name of the landlord
  • Rent – amount of money payable by the subtenant to the tenant each month

Agreement to Sublease

This section states that the tenant agrees to lease the subtenant and the subtenant hereby agrees to temporarily accept from the tenant for the term specified below, and upon all conditions set forth herein, that portion of the tenant’s interest in the premises, including improvements.

Term

Landlord Approval

Mark the appropriate box indicating the landlord’s approval. You may select:

  • The tenant requires the landlord’s written approval to sublet the premises. In the event that the original lease requires the approval of the landlord prior to any subletting of the premises by the tenant, then the validity of this sublease is subject to securing the approval of the landlord. Should the tenant fail to secure the landlord’s approval of this sublease prior to such date, this sublease shall be null and void. Rent

This section states that the subtenant will pay to the tenant the total sum of (enter the amount in dollars) for the term, payable in advance in monthly installments of (enter the amount in dollars) due on the (enter the date) day of each month during the term. The first rent payment is payable to the tenant when the subtenant signs this sublease. Security Deposit

This section states that upon signing this sublease, the subtenant will pay a security deposit in the amount of (enter the amount in dollars) to the tenant. The security deposit will be retained by the tenant as security for the subtenant’s performance of its obligations under this sublease.

If the subtenant does not comply with any of the terms of this sublease, the tenant may apply any or all of the security deposit to remedy the breach, including to cover any amount owed by the subtenant and/or any damages incurred or costs incurred by the tenant due to the subtenant’s failure to comply. The tenant will provide the subtenant with written notice of use of any or all of the security deposit. The subtenant will, within (enter the number of days) days following receipt of such written notice, pay to the tenant the amount needed to restore the security deposit to its full amount.

The security deposit may not be used or deducted by the subtenant as the last month’s rent of the term. The subtenant will be entitled to a full refund of the security deposit if the subtenant returns possession of the premises to the tenant in the same condition as accepted, ordinary wear and tear excepted. Within (enter the number of days) days after the termination of this sublease, the tenant shall return the security deposit to the subtenant (minus any amount applied by the tenant in accordance with this section).

Tenants Failure to Give Possession

This section states that in the event the tenant is unable to deliver possession of the premises to the subtenant on the start date of the term, the tenant will not be subject to any liability for such failure, the validity of this sublease will not be affected, and the term will not be extended.

The subtenant will not be liable for rent until the tenant gives possession of the premises; provided, however, that if the tenant does not give possession of the premises to the tenant within (enter the number of days) days from the start date of the term, the subtenant may cancel this sublease by notice in writing.

Holdover Tenancy

This section states that unless this sublease has been extended by mutual written agreement of the parties, there will be no holding over past the term of this sublease under any circumstances. If it becomes necessary to commence legal action to remove the subtenant from the premises, the prevailing party will be entitled to attorney’s fees and costs in addition to damages.

Use of Premises

This section states that the premises will be occupied only by the subtenant and used only for residential purposes. The subtenant agrees not to use the premises for any unlawful or hazardous purpose.

Condition of Premises

This section states that the subtenant has examined the premises, including all appliances and fixtures (mark the box if the premises includes furnishings), and acknowledges that they are in good condition and repair, normal wear and tear excepted, and accepts them in its current condition.

At the end of the term, the subtenant agrees to surrender and deliver the possession of the premises to the tenant, including all appliances and fixtures (mark the box if the premises includes furnishings), in as good a condition as they were at the commencement of the term, reasonable wear and tear excepted.

This section further states that the subtenant will be liable to the tenant for any damage occurring to the premises and any damage to or loss of the contents thereof which are done by the subtenant or the subtenant’s guests or invitees.

Maintenance and Repairs

This section states that the subtenant will maintain the premises, including the grounds (if the premises is a house) and all appliances and fixtures (mark the box if the premises includes furnishings), in clean, sanitary and good condition, and repair. The subtenant shall not paint, otherwise redecorate, add or change locks, or make any other alterations to the premises without the prior written consent of the tenant. The subtenant will not remove the tenant’s or the landlord’s appliances and fixtures (mark the box if the premises includes furnishings) from the premises for any purpose.

If repairs other than general maintenance are required, the subtenant will notify the tenant of such repairs. In the event this sublease includes shared common areas, appliances, fixtures and furnishings, the subtenant shall be entitled to the reasonable use thereof and shall be responsible for repairing or replacing the foregoing in the event they are damaged or missing due to any act or omission of the subtenant.

Smoking

Properly trained service animals that provide assistance to individuals with disabilities will be permitted on the premises with the prior written consent of the tenant. The subtenant will be responsible for the costs of de-fleaing, deodorizing, and/or shampooing all or any portion of the premises if a pet has been on the premises at any time during the term.

Inspection Checklist

Mark the appropriate box if the subtenant is required to complete an inspection checklist. You may select:

  • In order to avoid disagreements about the condition of the premises, the subtenant will complete the inspection checklist incorporated herein and record any damage or deficiencies that exist at the commencement of the term. Obligations of the Parties

This section states that the subtenant agrees to assume and agrees to perform and comply with all of the obligations and responsibilities of the tenant under the original lease for the term, except as otherwise set forth in this sublease. The subtenant agrees to comply with all applicable laws, ordinances, requirements, and regulations of any federal, state, county, municipal, or other authority.

The tenant agrees to maintain the original lease for the length of the term, subject, however, to any earlier termination of the original lease without the fault of the tenant. The tenant will remain obligated to pay rent and perform and comply with all of its obligations under the original lease or by law, including, if applicable, payment of resident income tax.

Liability

This section states that the tenant is not responsible or liable for any loss, claim, damage, or expense as a result of any incident, injury, or damage to any person or property occurring anywhere on the premises, including but not limited to the subtenant and invitees of the subtenant, unless resulting from the gross negligence or willful misconduct of the tenant.

Right of Entry

This section states that the tenant or the landlord or their respective agents may enter the premises at reasonable times to inspect, make any alterations, improvements, or repairs, or to show the premises to a prospective tenant, buyer, or lender.

In the event of an emergency, the tenant or the landlord may enter the premises at any time.

Assignment or Subletting
