What is Form REG 256?

Form REG 256, Statement of Facts, is used by California residents to make factual statements about their motor vehicles or vessels.

How to fill out Form REG 256?

To fill out Form REG 256, you must provide the following information:

License Plate or CF Number

Enter the license plate number or permanent registration number of your motor vehicle or vessel.

Vehicle or Vessel Identification Number (VIN)

Enter the vehicle or vessel identification number (VIN) of your motor vehicle or vessel.

Year or Make

Enter the year or make of your motor vehicle or vessel.

Section A. Statement for Use Tax Exemption

Mark the appropriate box which corresponds to the reason why your transfer is exempt from use tax. You may select:

• Family transfer sold between a parent, child, grandparent, spouse, domestic partner, or siblings if said siblings are both minors who are related to you by blood or adoption
• Additional or deletion of a family member that includes the following:
  • Spouse
  • Domestic partner
  • Parents
  • Son or daughter
  • Grandparents
  • Grandchildren
• A gift that does not include vehicles traded between individuals, transfer of contracts or other valuable consideration
• Court order
• Inheritance

The Use Tax Exemption cannot be claimed if your motor vehicle or vessel being transferred was purchased from an otherwise qualifying relative who is engaged in the business of selling the same type of motor vehicle or vessel.

Enter the current market value of the motor vehicle or vessel in U.S. dollars.

Section B. Statement for Smog Exemption

Mark the appropriate box which corresponds to the reason why your motor vehicle or vessel does not require a smog certification for transfer or ownership. You may select:

• The last smog certification was obtained within the last 90 days
• The motor vehicle or vessel is powered by one of the following:
  • Electricity
  • Diesel
  • Other - Specify what your motor vehicle or vessel is powered by.
• It is located outside the State of California with the exception of Nevada and Mexico
• It is being transferred from or between the following:
  • The parent, grandparent, child, grandchild, brother, sister, spouse, or domestic partner of the transferee
  • A sole proprietorship to the proprietor as owner
  • Companies whose principal business is leasing vehicles and that there is no change in lessee or operator
  • Lessor and lessee of vehicle and there is no change in the lessee or operator of the vehicle
  • Lessor and person who has been the lessee’s operator of the vehicle for at least one year
  • An individual being added as a registered owner

This does not require a smog certification unless a Biennial Smog is required.

Section C. Statement for Transfer Only or Title Only

Mark the appropriate box which corresponds to the type of statement you are applying for. You may select:

• Transfer only
• Title only

By marking one of the boxes, you are certifying that your motor vehicle or vessel is not currently registered and has not been used or parked on a street, highway, or off-highway. Furthermore, it has not been driven, moved, towed, or left standing on any California public highway to cause registration fees to become due. It was also not transported over any California public highway or operated within California to cause off-highway fees to become due. Appropriate registration will be obtained before your motor vehicle or vessel is operated.

Section D. Window Decal for Wheelchair Lift or Wheelchair Carrier

Enter your Disabled Person License Plate, Disable Veteran License Plate, or Permanent Disabled Person Parking Placard number.

Disabled Person Plate

Enter the Disabled Person Plate number of your motor vehicle or vessel.

Disabled Veteran Plate

Enter the Disabled Veteran Plate number of your motor vehicle or vessel.

Permanent Disable Person Placard

Enter the Permanent Disable Person Placard number of your motor vehicle or vessel.

Window Decal

The vehicle to which your Window Decal will be affixed is the following:

License Number

Enter the make of your motor vehicle or vessel.

Section E. Statement for Vehicle Body Change

Current Market Value of the Vehicle or Vessel

Enter the current market value of your motor vehicle or vessel in U.S. dollars.

Changes of Cost

Enter the cost of the changes that were made in U.S. dollars.

Date of Changes

Enter the date when the changes in cost were made.

Changes Made

Mark all of the appropriate boxes which correspond to the type of changes you have made. You may select:

• Unladen weight has changed - Enter the reason for the unladen weight change for your motor vehicle or vessel. You must submit your Public Weighmaster Certificate along with this Form REG 256.
• Motive Power has changed - Enter the specific changes to the motive power of your motor vehicle or vessel.
• Body type has changed - Enter the specific changes to the body type of your motor vehicle or vessel.
• Number of axles has changed - Enter the specific changes to the number of axles of your motor vehicle or vessel.

You must submit your Ownership Certificate along with this Form REG 256.

Mark the appropriate boxes which correspond to your name statement. You may select:

      • Enter your previous and current full legal names in the spaces provided to certify that you are both the same person.
